From July 1, 2017, part of the Federal Law No. 290 comes into force, amending the Federal Law No. 54 on the use of cash registers (CREs). Under the new law, entrepreneurs must use a special CREs to send data to the tax office every time they accept money from buyers for goods or services. And this applies to online stores and services that could not yet use the fiscal cash register.
By law, the seller of the goods/service or his agent (for example, a courier service or a retail outlet) must issue a check. Payment systems and aggregators are neither sellers nor agents, therefore it is the seller who must send an electronic check to the buyer and transfer a copy of it to the tax office.
If you are already using a cash register (for example, for pickup sales), then you will need to switch to using a new technique. Some cash registers can be upgraded (by replacing the ECLZ module with a new type of fiscal drive), but if upgrade is not possible, then you will need to select and buy a new cash register.
If you do not yet have a cash register and you only accept payments on the Internet, through payment systems or aggregators, then you will also have to buy and use a cash register with a fiscal drive to transfer data to the Federal Tax Service. When choosing a suitable solution, you should pay attention to whether it is “friendly” with your site’s CMS, as well as with a payment system or aggregator.
An upgraded or new device with a fiscal drive will need to be registered in your personal account on the tax website (this requires a qualified electronic signature, which can be obtained at a certification center). When registering a cash register, indicate not only the physical address of its use, but also the address of your website – then online payments can be taken into account in the tax using the same device.
Data from the CREs to the tax office is transferred by a separate organization – the operator of fiscal data (OFD), a license is required for this activity. By July 1, you will need to conclude an agreement with one of the OFDs to transfer data from your cash register to the tax office. A list of all licensed OFDs is on the tax website, each OFD legally supports work with all CREs, so you can choose anyone.
